Legal stuff to using companies trademarks?

I want to use other companies names logos and trademarks on a product. I am going to obtain their permission first but was wondering what sort of contract needs to be drawn up. If it can be as simple as a letter stating the permission is granted or if it needs to be more in depth to cover myself? If so what sort of contract.

As has already been said, you'll need legal help on this one. There are all sorts of things that the companies will want to cover themselves against - being seen to endorse your products and the possibility that you could be considered to be passing off your goods as coming from their company are just two that spring to mind.

Own It is a very good organsiation that offers free information on protecting intellectual property, particularly in the creative industries. You need to register on their site, which is free, and you then have access to contracts that you can download. You can also, if you're in the London area, have a 1-2-1 session with one of their advisors. (We're just about to have one on a product we're creating.)

The other people who are good for the same sort of thing is the British Library. Check out their Intellectual Property section.

  • First of all, write them a simple letter explaining your business proposition and politely asking their permission. If they agree, you will need to speak to a solicitor to get a contract drawn up. You must speak to a solicitor/
